Terms and Conditions for Online Gift Vouchers purchased from Your Market Place
These terms and conditions apply to the purchase and use of the online gift vouchers found on Your Market Place website – www.yourmarketplace.com.au. These terms and conditions specifically refer to the Your Market Place (YMP) online gift voucher – a gift voucher which may be used with any business offering online gift vouchers on the Your Market Place website. Please note that online Your Market Place Gift Vouchers may also be subject to a business’ own set of terms and conditions.
By purchasing, redeeming or attempting to redeem a Gift Voucher you:
- Accept and agree to be bound by the Terms and Conditions;
“Gift Voucher” means a gift voucher purchased online from the Your Market Place website
“Participating Business” refers to a Business who maintains an online profile with Your Market Place
“Website” means the Your Market Place website, accessible at www.yourmarket place.com.au;
“Your Market Place” means Your Market Place Pty Ltd (ABN 15 609 363 233);
A reference to “us” or “we” is a reference to Your Market Place.
A reference to “you” or “your” is a reference to the person who purchases, possesses or attempts to use the Gift Voucher
Making a Purchase
When you purchase and/or use an online gift voucher from the Your Market Place website and tick the box that says ‘I understand and accept the Terms and Conditions’, you become legally bound by these terms and conditions. Please do not proceed to purchase/use your online gift voucher until you have read, understood and accepted these terms and conditions. Redeeming an Online Gift Voucher
The Gift Voucher is valid for all businesses participating in Your Market Place’s Gift Voucher program. See the options at www.yourmarketplace.com.au. This Gift Voucher may be used for goods, services or experiences offered by participating businesses, subject to conditions of the participating businesses and availability.
The Gift Voucher may be used across multiple businesses participating in the Your Market Place Gift Voucher program.
You can check your balance by clicking on Check My Balance tab on the website.
If making a booking, please let the business know you have a Your Market Place Gift Voucher and quote the Gift Voucher number.
Please present the Your Market Place Gift Voucher when redeeming.
The Gift Voucher is valid for a period of 12 months from the date of purchase.
The Gift Voucher is not redeemable for cash and has no monetary value.
Availability, upgrades and cancellations for the Gift Voucher are subject to the individual business’ terms and conditions.

The validity of the Gift Voucher will be confirmed prior to redemption.
Your Market Place does not take any responsibility for adverse outcomes or experiences such as personal loss or injury, accidents, product failure or performance arising from or associated in any way with the use of the Gift Voucher.

All gift voucher amounts include Goods and Services Tax (GST) at the current rate of 10%. Your Market Place will print, package and post Gift Vouchers for a fee of $5. Credit card and PayPal processing fees apply to purchases.
Transfer of Your Market Place Gift Vouchers
Your Market Place accepts no responsibility for any stolen or fraudulent Gift Vouchers. It is the holder’s responsibility to ensure the safe keeping of the Gift Voucher(s).
The validity of Gift Vouchers will be checked prior to redemption.
Lost or Damaged Gift Vouchers
If an online Gift Voucher is received and subsequently lost or damaged, the recipient may be eligible to have a replacement voucher emailed to them, subject to the conditions below.
Conditions for replacement of lost Your Market Place Gift Vouchers:
- The voucher is still valid and has not yet been exchanged or used.
- Proof of purchase is provided, including a copy of the receipt, purchaser’s full name and/or purchaser’s email address.
- Your Market Place is able to correctly verify you as the original recipient.
Please note it is the voucher recipient’s responsibility to obtain and provide Your Market Place with all required verification details. Failure to do so will mean no replacement voucher can be issued.
Expiry & Extensions: Gift Vouchers
Online Gift Vouchers must be used within 12 months of purchase. The expiry date is clearly displayed on all Gift Vouchers.
Any balance remaining on the Gift Voucher will not be available for use after the expiry date.
Gift Voucher Delivery
It is the responsibility of the purchaser to correctly address gift vouchers. Your Market Place is not responsible for any damaged, missing or delayed orders where incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided.
Delivery is via Australia Post’s standard mail service. Your Market Place accepts no responsibility for any damage, loss or delay as a result of using Australia Post’s service.
If for any reason your Gift Voucher doesn’t arrive, please contact us immediately and we can arrange for the Gift Voucher to be emailed to you free of charge once we have verified the original has not been used.
Providers of Goods and Services
Gift Vouchers are sold by Your Market Place on behalf of businesses that provide goods and services to customers.
It is the Individual Business which provides the goods or services following redemption of the gift voucher.
Your Market Place is not a provider of such goods and services and has no responsibility for any goods and services provided or not provided by the business offering the goods or service.
Your Market Place makes no warranty or representation regarding the standard of any goods or service to be provided.
Your Market Place makes no guarantees or warranties about the goods or services that are provided to you by the businesses selling Gift Vouchers for the goods and service.
Your Market Place makes no representations or warranties that businesses will continue to participate in the Your Market Place Gift Voucher program for the duration of the validity of the Gift Voucher.
The business offering the goods or service provides those goods and services directly to customers.
All online Gift Vouchers are issued subject to the terms and conditions of each business selling online Gift Vouchers and these Your Market Place terms and conditions.
Your Market Place does not control the business operations of any experience provider.
Your Market Place’s Liability
By agreeing to these Terms and Conditions you acknowledge, understand and accept that Your Market Place has:
- No liability for any act, omission or default, whether negligent or otherwise of any business selling Gift Vouchers on Your Market Place website; and
- No liability for any loss or damage occasioned by any negligent act or omission of any business selling Gift Vouchers on Your Market Place website.
Where Your Market Place’s liability cannot be excluded, such liability is limited to the value of the Gift Voucher purchased.
Complaints or Problems with your Gift Voucher
If you have a problem or a complaint regarding your online Gift Voucher purchased from the Your Market Place website, please bring it to the attention of the business from whom you purchased the Gift Voucher. This will assist the business to address the issue as quickly as possible. The photographs used on our websites to illustrate goods and services are provided to us by our online Gift Voucher businesses. They provide an indication of the goods and services you may experience, but are in no way a representation of the actual goods and services .
Your Market Place Legal Entity
Your Market Place website (www.yourmarketplace.com.au) is owned and operated by Your Market Place Pty Ltd (ABN: 73 551 580 291).
We reserve the right to change these terms and conditions without notice and you agree to be bound by any subsequent change. Changes to the Terms and Conditions will be available at [link to Terms and Conditions]
These Terms and Conditions are to be construed and enforced in accordance with the laws of Tasmania, Australia. Any dispute arising from your receipt or use of a Gift Voucher is exclusively subject to the jurisdiction of the Courts of Tasmania.
Terms and Conditions for Businesses Participating in Your Market Place Online Gift Voucher Program
As a participating Business in Your Market Place Online Gift Vouchers, the Business agrees to have a profile on the website at www.yourmarketplace.com.au and that it will accept Your Market Place Gift Vouchers for redemption at its Business.
The participating business agrees that Your Market Place will be entitled to a percentage of the Gift Voucher amount as payment for its services. The amount is available on enquiry from Your Market Place. It further agrees that Your Market Place may vary this amount from time to time. Your Market Place undertakes to provide a minimum of two weeks’ notice before varying the amount. Your Market Place may waive this fee for charities and not for profit groups.
The participating Business agrees to confirm the accuracy of the online Business profile when requested and provide updated information as necessary. Your Market Place will correct the information on the Business profile within 72 hours.
The Business agrees that it will comply with the terms of the Your Market Place Gift Voucher program as outlined above and will provide any information to a customer redeeming the Gift Voucher regarding the Business’ own terms and conditions. Furthermore, the Business will make every effort to provide the goods, service or experience to the customer. If there is a complaint from the customer, the Business will make every effort to resolve the complaint to the satisfaction of all parties.
The Business will confirm the validity of the Your Market Place Gift Voucher by logging onto Your Market Place and entering the Gift Voucher ID number. Failure to do so will mean that Your Market Place may not pay the Gift Voucher to the Business.
The Business will provide necessary information and grant a licence from the Business to Your Market Place to use the Businesses’ trademarks and logos on the Your Market Place website.
The Business is responsible for all images provided to Your Market Place and warrants that it has permission/ownership of the images provided. The Business hereby agrees to indemnify and hold indemnified Your Market Place, with regards to any claim, damages, expenses or other liabilities whatsoever arising from or associated with the use of the images by Your Market Place.
A participating business can decide to withdraw from Your Market Place Online Gift Voucher at any time and must do so by email or in writing.
Your Market Place reserves the right to remove the Business’ profile from our website for any reason whatsoever, provided that Your Market Place provides the Business with two weeks’ notice before doing so.
The Business agrees to indemnify and keep indemnified Your Market Place for all claims, damages, expenses or other liabilities whatsoever sustained, incurred or suffered by Your Market Place as a result of:
- the use of the Business’ trademarks, logos or other Intellectual Property by Your Market Place, including any claims that the use of the Business’ trademarks, logos or other Intellectual Property infringes third parties’ rights;
- the provision of goods or services by the Business to customers; and
- a breach by the business of the Terms and Conditions.
